　　广州4月25日电(方伟彬马卓尔陈中山)广东省高级人民法院25日出台《关于以高质量知识产权审判工作促进人工智能科技创新和产业发展的意见》(以下简称《意见》)。

　　据广东高院介绍，这是全国法院系统首份聚焦人工智能领域知产保护的司法政策性文件。《意见》将知识产权审判工作与科技创新规律、产业发展需求相融合，构建“创新链-产业链-法治链”三链贯通保护机制，为人工智能科技企业提供稳定、透明、可预期的创新法治环境，助力广东打造全球人工智能与机器人产业创新高地。

　　《意见》共24条，以高质量知识产权审判工作促进人工智能科技创新和产业发展为主线，以保护人工智能科技创新成果、促进人工智能产业公平竞争、完善人工智能司法治理体系为重点，围绕算法模型、开源许可、数据要素、生成内容等焦点，构建涵盖技术研发、成果转化、场景应用、市场竞争等全链条的司法保障机制，为人工智能科技创新和产业发展提供可落地、可持续的法治保障方案。

　　《意见》立足粤港澳大湾区“一点两地”全新定位，锚定服务粤港澳大湾区国际科技创新中心建设目标，加强司法引导人工智能技术多场景融合应用，充分释放“人工智能+”效应，促进人工智能赋能千行百业，服务广东制造业智能化转型升级。

　　《意见》强化发挥知识产权审判职能作用，系统提出了涉人工智能知识产权审判工作的五项基本原则，即“以人为本、公平普惠”“严格保护、宽容创新”“系统观念、场景意识”“开放共享、互利互惠”“规范有序、安全发展”，确保司法审判契合科技创新特点与产业发展规律，促进人工智能科技创新和产业发展向上向善。
